When can tax authorities provisionally attach bank accounts under GST?
Section 83 of the CGST Act allows provisional attachment of property, including bank accounts, during specified proceedings where the Commissioner is of the opinion that it is necessary to protect the interest of revenue. How is a first appellate GST demand order contested?
An order of the Appellate Authority can be appealed before the GST Appellate Tribunal under Section 112 of the CGST Act, subject to the prescribed time limit and pre-deposit. Where there is a violation of natural justice or a jurisdictional error, a writ petition before the High Court may also be considered.
